
Definition
These are women (sometimes men) who work at home to take care of children (sometimes in addition to their own).
They should not be confused with parental assistants (or home nurses, or in-home daycare) who look after children in the parents’ household and have no obligation to obtain approval in this regard.

Status of a childcare assistant
To become a childcare assistant, they submitted a request for accreditation to the General Council (of the department) and after an interview and a visit from a child welfare officer from PMI, they obtained the right (also called approval) to care for 1, 2, 3, or 4 children.
The training for childcare assistants includes 120 hours of mandatory training, which is divided into two components. The first part that the assistant must complete before welcoming the first child includes 60 hours and a day of first aid training. The second part, which includes the remaining 60 hours of training, must be completed within two years of starting the nanny’s activity.

The PMI daycare conducts an annual (unexpected) visit to check the conditions for welcoming children.
It is essentially defined by the National Collective Agreement for individual employer childcare assistants. The status of childcare assistants deviates from the Labor Code applied to “normal” employees on many points (weekly working hours, minimum wage, etc.), but also by the law of June 27, 2005 and its extensions, as well as by the Social Action and Family Code. In case of divergence between these texts, it is often the one most favorable to the employee that applies, but not always.
Childcare assistant homes
Some daycare assistants are grouped in “assistant homes”: in one of them, or in a rented room, they collectively welcome up to 15 children. But let’s not be mistaken: even if these homes resemble a mini-nursery, they are not, because the parents remain the only true employers of their childcare assistant.
In this case, parents can allow their childcare assistant to delegate this reception to other caregivers in the home, who can take care of the child in the absence of their nanny. This authorization must be included in the employment contract.
Family nurseries
Daycare assistants in family nurseries are employed by municipalities or associations (and not by the parent employers) and are supervised by early childhood professionals.
